Using Alternative Dispute Resolution in Agency Negotiations

Government agencies and private companies increasingly are using alternative dispute resolution in enforcement negotiations and litigation settlement generally. These half-day courses, which often are offered together, focus on the application of mediation and other ADR processes to settle enforcement cases, both before and after litigation has commenced.

Introductory ADR Training

This introductory course is designed to introduce participants to ADR and its application in the enforcement area. Participants will gain an understanding of:

  • Significant barriers to settlement in enforcement negotiations.
  • An overview of the types of ADR processes and their application to enforcement and other agency negotiations.
  • Differences between arbitration and mediation.
  • How to apply ADR, and tips for initiating and managing the ADR process.

Advanced ADR Training

This course is designed for individuals who have attended the introductory course, have other ADR training experience, or have participated in mediation cases as parties or as part of a case management team. In this course, the participants learn through case analysis and interactive discussion:

  • Application of ADR to specific case study examples.
  • The challenges of using ADR processes in the convening and mediation phases.
  • How to initiate and manage the ADR process
