Participation Agreements

Under some circumstances, particularly for disputes in litigation, parties find it helpful to have all sides sign an agreement to participate in the mediation process. Specifically, participation agreements can clarify ground rules concerning confidentiality, the mediator’s role, and terms of payment for the process.
